Ich habe gestern ein defektes Logitech Headset zum Händler gebracht um meinen Garantieanspruch geltend zu machen. Das Headset habe ich vor 10 Monaten bei diesem Händler gekauft.

Ich war ein wenig verblüfft, als der Verkäufer meinte, dass dann aber 10€ Manipulationsgebühr zu bezahlen wären. Er argumentierte, dass die Garantie ja nur "Ab Werk" gälte und ich quasi den Transport "Werk -> Geschäft" zu begleichen hätte. Bei einem Kaufpreis von 35€ ein happiger Betrag.

Auf mein "unglückliches Gesamterscheinungsbild"

meinte ein Kollege des Verkäufers relativ schnell, dass bei diesem Gerät nur 5€ zu bezahlen wären. Sie müssen das Gerät aber noch checken, ob meine Angaben stimmen. Ein wenig grummelnd willigte ich ein - was blieb mir auch anderes übrig.

Nach 10Minuten kam dann das ok, Fehler bestätigt, wird sofort ausgetauscht und - welch Wunder - plötzlich musste ich doch keine Manipulationsgebühr zahlen.

Meine Frage:
Ist so eine Gebühr für eine Garantieleistung überhaupt berechtigt. Ich habe eigentlich noch nie für eine Garantieabwicklung was zahlen müssen.

NOCH Fragen

Nein, ich habe keine Fragen. Ich kenne mich schließlich im Gewährleistungrecht aus. Du allerdings solltest nicht nur lesen, was gerade Deinen Standpunkt zu stützen scheint, sondern auch den Rest. Dann ist ganz eindeutig klar, dass weder Du noch der Betroffene diesen Fall als Gewährleistungsfall durchbringen wir[st|d].

Frag mich jetzt bitte nicht, warum! Lies die Änderungen des Gewährleistungsrecht (http://forum.geizhals.at/files/37/Gewahrleistungsrechts-Anderungsgesetz.pdf ) genau und vollständig (insbesondere §924, und bitte auch die Konsequenzen die sich aus diesem "harmlosen" Paragraphen ergeben zu bedenken), schlag hier im Forum zu diesem Thema nach und auch Du wirst hoffentlich verstehen, warum nach zehn Monaten ein Defekt kaum mehr als Gewährleistungsfall abgehandelt werden wird.

Und für den Garantiefall gilt das Gewährleistungsrecht im KSchG nun gar nicht (Ausnahme: Vertraglich zugesagte Garantien dürfen die Gewährleistung nicht einschränken.).
