Ein Bekannter betreibt eine private Homepage und hat diese Tage einen Brief von einem österreichischen Anwalt bekommen, welcher ziemlich ident mit den im Internet auffindbaren Vorlagen ist.
Es steht darin, dass seine Mandantin (ukrainischer Name ohne weitere Anschrift, etc) diese Homepage aufgerufen hat und feststellen musste, dass diese Google Fonts über die Google Server einbindet, was der DSGVO widerspricht.
Soweit theoretisch korrekt, allerdings ist die im Schreiben angeführte IP der Mandantin aus Kharkiv und ich kann mir nicht vorstellen, dass da eine Frau im Kriegsgebiet beim Rakenbeschuss sitzt und auf einer österreichischen Homepage herumsurft und dann noch die Zeit findet, im Quelltext nach Verweisen zu Google Fonts zu suchen.

Ausserdem hab ich mir mal die Mühe gemacht und in den Serverlogs vom Hoster nach dieser IP zu suchen, mit dem Ergebnis, dass von dieser IP aus kein einziger Aufruf in der letzten Zeit stattgefunden hat.

Meine Vermutung ist daher entweder, dass der gesamte Brief ein SCAM ist und gar nicht von diesem Anwalt stammt oder aber dieser bewusst massenhaft den gleichen Inhalt mit dieser IP versendet mit dem Hintergedanken, dass sich wohl kaum einer die Mühe macht oder das Wissen hat, weitere Nachforschungen zu machen, zumal nach allen "Drohungen" eigentlich besänftigt wird und auf eine einmalige Zahlung von 100+90€ geraten wird und damit dann alles erledigt angesehen wird, sogar keine weitere Verpflichtung zur Auskunft über die verarbeiteten Daten mehr besteht

Frage: hat jemand von euch ev solch eine Abmahnbrief erhalten bzw. ev. ein Anwalt unter euch, wie und ob man darauf überhaupt reagieren soll?

Moralisch gesehen sollte man den Wisch einfach wegwerfen dürfen, weil's mMn. nur als Druckmittel zur Zahlung des Vergleichs beigelegt wurde - womit dieses an sich legitime Werkzeug meinem Empfinden nach missbraucht wird. Schon klar, dass man es rechtlich (!) gesehen ausfüllen muss/soll und auch keine andere Auskunft bekommt (außer unter der Hand) - außerdem entsteht jetzt a wieder Geschäft für andere Anwälte und IT bzw. DSGVO Fachleute.

Wie gehabt, der urpsprüngliche DSGVO Verstoss durch Fonts soll gefixt bzw. vma. auch abgestraft werden...wobei selbst dass wohl a bissal fraglich ist und evtl. nochmal angeschaut wird - aber die Mahnwelle inkl. lieblos dazugepackter DSGVO Auskunft ist für mich a andere Gschicht.

Wie kann's eigentlich sein, dass man das tausendfach beipacken kann (was zumindest ja ein Grund sein kann, dass man eine Auskunft verweigert weil exzessiv, fragliche Legitimation usw)? WENN man bezahlt, verschwinden auf einmal *puff* alle Bedenken und man muss keine Auskunft erteilen - kann mir doch kein Mensch erklären, dass das in der Form legitim ist...entweder hast Bedenken oder net, die verschwinden doch nicht einfach so bei Zahlung - lächerlich, aber leider geht's durch.

Varianten:
...man erstattet Auskunft, evtl. fehlerhaft und bekommt evtl. Probleme.
... man verweigert die Auskunft, muss belegen warum - reicht vl nicht, man bekommt evtl. Probleme.
... man ignoriert den Brief bzw behauptet, ihn nie erhalten zu haben - dies wird aber bewiesen oder einem wird nicht geglaubt, und man bekommt evtl. Probleme.
... man erstattet Auskunft, hätte man nicht tun sollen, und bekommt evtl. Probleme.
... man macht irgendwas davon, evtl. passiert nix, weil der Typ evtl. mit anderen Dingen beschäftigt sein wird.

Trallala, viel österreichischer kann so a Gschicht net werden. Was passiert dem Herren eigentlich, falls er verurteilt wird (afaik sind's ja Anzeigen wegen gewerbsmäßigen Betrug udg?)? Sitzen geht er sicher nicht, also nur a Geldstrafe und dann kann er die ganzen falsch/nicht beantworteten Auskünfte einklagen gehen...bzw die ganzen Foren durchforsten und Rufschädigungsklagen udg. austeilen...also am Ende des Tages mit einem Plus aussteigen oder wie kann man sich das bitte vorstellen?
