Ein Bekannter betreibt eine private Homepage und hat diese Tage einen Brief von einem österreichischen Anwalt bekommen, welcher ziemlich ident mit den im Internet auffindbaren Vorlagen ist.
Es steht darin, dass seine Mandantin (ukrainischer Name ohne weitere Anschrift, etc) diese Homepage aufgerufen hat und feststellen musste, dass diese Google Fonts über die Google Server einbindet, was der DSGVO widerspricht.
Soweit theoretisch korrekt, allerdings ist die im Schreiben angeführte IP der Mandantin aus Kharkiv und ich kann mir nicht vorstellen, dass da eine Frau im Kriegsgebiet beim Rakenbeschuss sitzt und auf einer österreichischen Homepage herumsurft und dann noch die Zeit findet, im Quelltext nach Verweisen zu Google Fonts zu suchen.

Ausserdem hab ich mir mal die Mühe gemacht und in den Serverlogs vom Hoster nach dieser IP zu suchen, mit dem Ergebnis, dass von dieser IP aus kein einziger Aufruf in der letzten Zeit stattgefunden hat.

Meine Vermutung ist daher entweder, dass der gesamte Brief ein SCAM ist und gar nicht von diesem Anwalt stammt oder aber dieser bewusst massenhaft den gleichen Inhalt mit dieser IP versendet mit dem Hintergedanken, dass sich wohl kaum einer die Mühe macht oder das Wissen hat, weitere Nachforschungen zu machen, zumal nach allen "Drohungen" eigentlich besänftigt wird und auf eine einmalige Zahlung von 100+90€ geraten wird und damit dann alles erledigt angesehen wird, sogar keine weitere Verpflichtung zur Auskunft über die verarbeiteten Daten mehr besteht

Frage: hat jemand von euch ev solch eine Abmahnbrief erhalten bzw. ev. ein Anwalt unter euch, wie und ob man darauf überhaupt reagieren soll?

Die WKO Antwort, die ich erhalten habe, ist ja auch im Prinzip genau das bzw. was ich auch erwartet hab'...vl kommt mehr, vl nicht - zahlen ist die einfachste Methode. Die Frage ist, ob man das halt macht, weil logischerweise ist das Ganze ja auf dem Prinzip aufgebaut. Lieber zahlen, weil man kein Geld hat, um Größeres abzufangen oder halt ka Zeit oder Bock auf Scherereien hat.

Bei mir ist's die Kombi aus z'wenig Geld für a große G'schicht und die nächsten 2-3 Wochen exakt gar keine Zeit für größere Unternehmungen, weil sonst mei Projektabgabe gefährdet wird. Ich hab' finanziell, va nach den letzten Jahren und der Zeit die kommt, a paar Monate Puffer falls ich krank werde und net arbeiten kann...die Kohle sollte ich eher net in ein Verfahren pulvern, selbst wenn die Chance auf eine Verfahren usw gering sein sollte. Bitte deine Erkenntnisse von deinem Anwalt up to date halten!

Gegen zahlen spricht bei mir ebenso der fahle Beigeschmack einer potentiellen Abzocke - DASS meine Seite nicht regelkomform war, steht völlig außer Frage. Wäre es ein interessierter potentieller Kunde gewesen, würde ich sofort blechen, egal was ich davon halte...ich bezweifle, dass diese Eva Z. das ist.

In AT finde ich mit Sicherheit zehntausende Seiten, die ich so abmahnen könnte...dann könnte ich als einzelne Person alle ansurfen und abmahnen lassen. Zumindest hab ich ein paar Mal gelesen, dass dies nicht erlaubt ist - ist das jetzt so ein Fall oder nicht? Ab wann? 5mal die selbe Mandantin, 100, 1000fach? Ohne Recherche wüsste ich nicht mal, ob diese Eva Z nur mich abmahnen lassen möchte oder mehr...100€ bzw 90€ zehntausendfach ist eine nette Summe für Anwalt und "Geschädigte" - aber das ist halt mein Stammtischbauchgefühl und nicht die Rechtslage, damit kann ich mich logischerweise brausen gehen.
