Ein Bekannter betreibt eine private Homepage und hat diese Tage einen Brief von einem österreichischen Anwalt bekommen, welcher ziemlich ident mit den im Internet auffindbaren Vorlagen ist.
Es steht darin, dass seine Mandantin (ukrainischer Name ohne weitere Anschrift, etc) diese Homepage aufgerufen hat und feststellen musste, dass diese Google Fonts über die Google Server einbindet, was der DSGVO widerspricht.
Soweit theoretisch korrekt, allerdings ist die im Schreiben angeführte IP der Mandantin aus Kharkiv und ich kann mir nicht vorstellen, dass da eine Frau im Kriegsgebiet beim Rakenbeschuss sitzt und auf einer österreichischen Homepage herumsurft und dann noch die Zeit findet, im Quelltext nach Verweisen zu Google Fonts zu suchen.

Ausserdem hab ich mir mal die Mühe gemacht und in den Serverlogs vom Hoster nach dieser IP zu suchen, mit dem Ergebnis, dass von dieser IP aus kein einziger Aufruf in der letzten Zeit stattgefunden hat.

Meine Vermutung ist daher entweder, dass der gesamte Brief ein SCAM ist und gar nicht von diesem Anwalt stammt oder aber dieser bewusst massenhaft den gleichen Inhalt mit dieser IP versendet mit dem Hintergedanken, dass sich wohl kaum einer die Mühe macht oder das Wissen hat, weitere Nachforschungen zu machen, zumal nach allen "Drohungen" eigentlich besänftigt wird und auf eine einmalige Zahlung von 100+90€ geraten wird und damit dann alles erledigt angesehen wird, sogar keine weitere Verpflichtung zur Auskunft über die verarbeiteten Daten mehr besteht

Frage: hat jemand von euch ev solch eine Abmahnbrief erhalten bzw. ev. ein Anwalt unter euch, wie und ob man darauf überhaupt reagieren soll?

Die WKO hab i persönlich eh schon lange auf'n Kieker...mit 2 Gewerben hab' ich alles zamm schon an Haufen Kammerumlage bezahlt. Newsletter und die lustigen Spartenzeitschriften brauch i net, ebenso die Vorträge (da bringen ma YT Videos mehr) und Veranstaltungen...zahlen muss i trotzdem.

Wenn ich mal eine Frage hatte, auf die ich explizit schriftlich eine Antwort haben wollte (damit i was vorweisen kann) wurde ich trotzdem nur angerufen...damit's keinen Nachweis gibt oder was? Und die Antworten sind meist schwammig genug, die kann i ma ah selbst in 15min auf Google zammsuchen. Die Standardmailantwort zu dem aktuellen Anliegen bringt ma ah nix...so nach dem Motto KÖNNTE ein Verfahren entstehen, kann teuer werden...vl passiert ah nix, muss man abwarten. Der Service bei Unternehmensgründung war top, aber über die Jahre Umlagezahlungen dann ah net a paar Tausender wert.

Ist mir schon klar, dass es lt. Gesetz zig Szenarien gibt und man net definitiv sagen kann, was passiert usw...was ich aber erwarte: Da haben sicher schon Dutzende oder Hunderte Leute angerufen und ich wette, der Name Eva Z ist schon mehrmals gefallen...Bauchgefühl haben viele, dass es eine Abzockesein könnte (ich rede vom gezielten (!) anpeilen und abmahnen der Seiten)...als meine Interessenvertretung würde ich erwarten, dass sie das zB mal als Angriffspunkt checken und mehr auf'n Kasten haben, als ich mit a bissal Google Recherche (inkl. IP Übertragung).

Aber zur Zeit bin ich halt gerade a bissal emotional - wahrscheinlich ist alles viel schwieriger und komplizierter, der Bürokratie sei Dank.

Nochmal: Meine Seite war datenschutzkonform nicht korrekt umgesetzt, mit 190€ Lehrgeld kann ich leben und die mögen gerechtfertig sein - ich will es explizit dem Typen aber net geben, oder zumindest nicht ohne Nachspiel, FALLS diese ganzen Seiten gezielt zum Abmahnen angeilt wurden.

Wenn sowas durchgeht, könnte ich doch auch innerhalb kürzester Zeit Millionär werden oder zumindest a nettes Taschengeld lukrieren...dann fang ich auch an, ein paar Tausend Seiten abzucrawlen und abzumahnen - vom Prinzip her ja keine blöde Idee. I will gar net wissen, wieviele Leute noch tote Homepages haben...zB von Projekten, Veranstaltungen, gestorbenen Ideen bzw Interessen und was weiß ich, beschränkt sich ja net nur auf Unternehmen.

Mein weiterer Gedanke...bei denen anrufen. Sich die Sachlage erklären lassen, ob das auch wirklich von ihnen kommt, denn auf den ersten Blick wirkt das Schreiben auf mich wie ein Scam. Wer diese Eva Z denn sei und wie genau ihr die 100€ Schaden zustande kommen sind, warum ist sie genau auf meine Seite gekommen - scheint ja nicht aus der Gegend zu sein und ich arbeite lokal, wie genau sich die 90€ Spesen zusammensetzen. Was als nächstes passiert wenn ich zahle bzw nicht zahle, ob man da noch was machen könnte...also alles Details zu dem Fall, weil ich versteh' da a paar Sachen net. Außerdem um a Fristverlängerung bitten, weil i muss das rechtlich erst no checken bzw mich bei einem IT Fachmann entsprechend informieren bzw. die Umsetzung beauftragen usw. Sollten vielleicht alle Betroffenen machen, die sich net so gut mit der Sachlage auskennen, vl. ist eine umfangreiche Auskunft in den 90€ inkludiert?
